What Would You Tell Clients Who Are Hesitant about Filing a Lawsuit?

What would I tell clients that are hesitant about filing lawsuits? That’s a common issue, particularly in Utah. Folks are really worried about filing a lawsuit because they don’t like the stigma that comes with it. We know this. We actually talk to our clients about this when we get ready for depositions if their case goes that far. We call it tort reform and what we mean by that is that, you know, over the years, there’s been a push by certain advocate groups to try to really make folks feel uncomfortable about filing lawsuits and bringing claims. And so, what we try to do is kind of re-educate folks and say, hey, look, when you bring these claims, it’s not something you should feel guilty about. You should be proud about it. You’re being courageous, you’re putting yourself out there, and one of the reasons you’re probably doing it is because you want to make sure that this doesn’t happen to somebody else. You want to make sure that another kid doesn’t get hit in a crosswalk. You want to make sure that another patient doesn’t have a doctor leave a surgical implement inside them and cause them additional harm. You’re being courageous. You are helping make our community safer.
