Ways You Can Prove Negligence in Accidents

There is multiple ways to prove negligence in a car accident case. The primary piece of evidence is typically a police report. Police reports are often done well and we have the evidence we need to prove up liability without any argument from really any side. When police reports are not done well then we have to dig a little further. So we can look at a lot of different things. We can look to see if there’s any video; dash cam video is becoming more popular. We can look to see if local businesses have video. We send out preservation letters to businesses if we have a case where we know it’s going to be a dispute as to what happened and try to find video that can prove our case. You can look at what’s called black box data; that data is super important in cases where we have a dispute as to what happened, and so we send out preservation letters to make sure they don’t get rid of the vehicle and send our experts in to pull the data and tell us what happened. Those are kind of the primary things. You know, once you’re litigating a case, you can get more access to information. You can send out subpoenas for phone records to see if there was a distraction with texting or calling. In cases that don’t involve a car, so like a slip and fall, we can send our experts into a business,  in an enter an inspect, to kind of look at you know what the floor looks like, is it a slip-resistant floor, or not. Those are some of the examples I can think of.
